Privacy Policy

This Privacy Policy describes how Productions, LLC (“Company” or “us”), collects, uses and shares personally identifiable information (“PII”), such as your name, address, email address and date of birth, that it obtains from individuals located in the United States in connection with their use of the online interactive game and website currently entitled “The Migrant Trail” (the “Game”), the software program for the Game (the “Software”), the website for the Game located at www.themigranttrial.com (the “Site”) and the Game itself. The term the “Service” refers to the Game, the Software, the Site, their contents as well as related software applications, plug-ins, and other services and applications available on the Site. We will not affirmatively notify users of changes in our Privacy Policy; but we will abide by the Privacy Policy in effect at the time we collect PII from a visitor, respecting uses of that PII. In the event that you access the Game from a third party social network site (e.g., Facebook) (a “Third Party Site”), you may be required to also review and agree to the terms of service and privacy for such third party site.
The Company is committed to the safety of children. Children under the age of 13 may not register or participate in any of the Services. If children under 18 elect to register for any of the Services, they should ask a parent for permission before sending any information to the Service. We will not request or knowingly collect any PII from a child under 13.
By using the Game, the Software, the Site or any other part of the Service you agree to and accept the terms of this Privacy Policy.
1. Collection of PII by Company.
When you register with the Service or a Third Party Site, you provide us with certain personal information, such as your name, email address, a user name, password, date of birth, gender and physical address. If you purchase any of the services offered on the Site (to the extent any is offered), you will also provide us with your credit card information and billing address.
When you use the Software via mobile access (to the extent we offer such use), we will automatically collect information regarding your mobile device, such as mobile phone number, device type, operating system version, mobile carrier and connection type, analytic usage data (for example, screen swipes and touches) and data relating to any Software crashes.
If you OPT IN, we may also access and use the address book, contact lists or other similar items contained in the devices to which you have downloaded the Software for purposes of your use of the Service.
When you enter the Site, we collect your browser type and IP address, referring web page and pages visited. We also store certain information from your browser using cookies and web beacons, which allow the Company to identify, among other things, whether you are a new visitor or a returning visitor, and to remember your preferences (for example, which media player you use or your password). Cookies and web beacons also may help the Company monitor site usage and traffic so we can better configure the site for visitors’ needs. Although we may record information about your usage and associate that information with you, PII will not be collected by or stored on a cookie or web beacon.
Unless and until you OPT OUT, the Company may record geolocation data identifying the location from where you access the Service, if available, and will publish your location in your profile.
If you voluntarily disclose any PII or other information or content for public posting on your Game profile or otherwise within the Service, it will become publicly available and can be collected and used by others.
You post any content on the Service at your own risk. Even though we may allow you to set privacy options which limit access to your Game profile, please be aware that no security measures are perfect or impenetrable. In addition, we cannot control the actions of other users with whom you may choose to share your personalized page or your password or log in information. Therefore, we cannot and do not guarantee that content you post on the Service, even if designated as private, will not be viewed by unauthorized persons. We are not responsible for any circumvention of any privacy settings or security measures contained on the Service. You understand and acknowledge that, even after removal, copies of any content you post to the Service may remain viewable in cached and archived pages or if other users have copied or stored your content.
2. Use of PII by the Company.
We may use PII to send you notifications about new services offered by the Company. We may use your PII to address you personally throughout your visit at the Game and to otherwise provide personal services to you. We may use PII for internal purposes to better understand the use of the Service and how to make your use easier and more enjoyable. The Company may also use your name and/or email address for customer service purposes, to send you news about the Game or related issues and for non-marketing or administrative purposes (like notifying you of major changes to the Service).
Your name, user name and other information that you choose to provide for your Game profile page will be displayed to other users of the Service on your profile page (and on a Third Party Site) and will be displayed as part of communications and/or content that you send and viewable at the same level (for example, private, selected users only, public) that you have selected to be able to view your content. Those users will be able to contact you through the Service. Such information may also be available to third parties through a Third Party Site.
We do not use your PII to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to OPT IN or OPT OUT. We may, however, use content or information that you have shared publicly on the Service in member communications, such as newsletters, and advertising and promotion for the Service.
3. Use of PII by Third Parties.
The Company may use third party APIs to distribute content to other social media platforms, websites and services. We will not share your PII with third parties unless and until you OPT IN to these APIs and elect to share specific content with these third parties, provided, however, any PII may be shared with Third Party Sites through which you enter the Game.
Unless and until you OPT OUT, the Company may send you opportunities to participate in offers made by the Company and the Company’s business partners and advertisers.
When you give us information for a specific purpose, we will use that information solely for that purpose unless we tell you otherwise and give you an opportunity to OPT OUT. We may also share your PII with third parties who provide support for the internal operations of our website and who will not disclose or use that information for any other purpose, with a third party in the event of a transfer of ownership or assets, or bankruptcy, by the Company’s owners, or as required or permitted by law, to protect the interests or safety of the Company or a third party, or in an emergency situation.
We may share with third parties aggregated non-personal information, which might include, for example, how many visitors watched a video or clicked on a specific advertisement. Such information does not identify you personally, however, and is not PII.
4. Linked Websites.
The Service might contain links to websites operated by third parties. We are not responsible for the privacy practices of other websites or of third parties that advertise on the Service. We encourage you to be aware when you leave the Game, the Software or the Site and to read the privacy policies of each and every website that collects PII. This privacy policy only applies to PII collected by us on the Service.
5. Third Party Advertisers.
The Company may allow other companies to place advertisements within the Service. These third party advertisers use technology to send, directly to your browser, the advertisements and links that appear on the Service. These third party advertisers automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see.
6. Internal Security.
We use commercially reasonable administrative, technical, personnel and physical measures to safeguard PII in our possession against loss, theft and unauthorized use, disclosure or modification. However, no safeguards or data transmissions over the internet are 100% secure and we cannot ensure in all circumstances the security of information you transmit to the Company. You do so at your own risk.
7. International Visitors.
The Service is hosted in the United States. If you visit the Service from the European Union or other areas outside the United States with laws governing data collection that differ from the laws of the United States, please understand that you are transferring your PII outside of those jurisdictions to the United States for the uses identified in this Privacy Policy. By providing your PII, you consent to that transfer.
8. Your Access to your PII.
If you would like to know the categories of PII that we collect from visitors to the Service, please contact us. If you would like to know whether we have collected PII about you, please send us the activities that you participated in at the Service which requested PII and after reviewing the relevant databases, we will confirm whether we have collected such information about you. You may review PII about you in our records at any time provided you first give us proof of your identity, such as by accurately stating a password. You can update and change your PII by modifying your account information, and we will change any inaccuracies in the PII that pertains to you in response to a reasonable request, and/or end any direct communications with you, or even delete your PII altogether, except to the extent we are required to do otherwise under law.
